Welcome to my website. This document explains clearly and transparently how purchases work, what your rights are as a customer, and when the right of withdrawal applies (or does not apply). Please read it carefully before placing an order.
1. Who I am
The website www.stefaniamorgante.com (the “Website”) is operated by:
Gufobardo di Stefania Morgante (sole proprietorship of Stefania Morgante) Via Primo Maggio 2, 33017 Tarcento (UD), Italy Italian VAT / Tax Code: IT02721330922 Email: info@stefaniamorgante.com
In this document I refer to myself as “Seller” or “Artist.”
2. Scope of these conditions
These General Conditions of Sale govern:
the sale of products through the Website,
the rights and obligations of the customer,
delivery, return and refund procedures,
everything needed to ensure a clear and secure relationship between me and you.
These Conditions apply to all orders placed through the Website, both by customers residing in Italy and the European Union, and by customers from the United Kingdom, Switzerland, the United States and other non-EU countries.
3. What I sell
On the Website I sell:
Original artworks (OOAK — one-of-a-kind): illustrations, drawings, watercolors on paper, paintings on canvas. Each artwork exists as a single piece.
Scarves (one-of-a-kind): catalogue items, each in an edition of 1 of 1, made from my own designs and hand-hemmed.
Handmade notebooks: hand-illustrated and hand-painted notebooks (front cover, back cover, and inside front and back covers); unique catalogue items.
Gadgets: canvas bags, Christmas calendars (seasonal), Christmas cards (seasonal), occasional pins.
Colouring books / Do it yourself.
Commissioned works: portraits on paper (of people or animals) made on customer request — see section 11.
The books I have published (“Life — A colouring book”, “La Signorina Illustratrice”, “The Christmas Tragedy”) are sold through Amazon and are governed by Amazon’s own policies, not by these Conditions.
4. Who can purchase
You may purchase on the Website if you:
are at least 18 years old,
act as a consumer, i.e. for personal purposes and not for professional, commercial or craft activity.
Orders from parties other than consumers may not be accepted.
5. Product description
Each product is described as accurately as possible. Colours shown on screen may differ slightly from real ones due to lighting, monitor settings or the handmade nature of the product. Images are therefore for illustrative purposes, but the essential features of each product are always indicated on its page.
Since most of the items are handmade and one-of-a-kind, each piece may show small variations that constitute its handcrafted character and uniqueness.
6. Availability
I try to keep stock availability up to date in real time. However, since most items are unique pieces (1 in stock), if two customers purchase the same item at the same time, it may turn out to be sold out after the order. In that case, you will receive an email notification and a full refund or, if you prefer, you can replace the item with another one by letting me know.
7. Prices and currency
All prices are shown in Euros (€) and include Italian VAT where applicable to my tax regime.
For orders from non-EU countries (e.g. United Kingdom, Switzerland, United States), the displayed price does not include any customs duties, import VAT or local taxes, which remain entirely at the recipient’s charge.
Prices may change over time, but the valid price is always the one shown at the moment of the order.
Shipping of paintings and canvas works: for paintings on canvas, the shipping price is not specified on the product page because it varies depending on dimensions, weight, dedicated packaging and destination. I will contact the customer immediately after the order to agree on the most suitable courier and shipping cost, before final confirmation.
8. Payment methods
I accept the following payment methods:
PayPal (including “Pay in 3” where available),
Stripe (credit and debit cards),
Credit cards (Visa, Mastercard, American Express, etc.).
Payment is due at the time of the order, with the exception of commissioned works (see section 11). Payment data is handled securely by the respective providers: I never store nor have access to your banking or card details.
9. Contract conclusion and checkout procedure
To complete the order you need to follow the Website’s guided checkout procedure, which includes:
selecting the products;
a) entering shipping and billing details;
b) viewing the order summary with total price, shipping costs (where pre-calculable) and any exclusions from the right of withdrawal;
c) choosing the payment method;
d) final confirmation by clicking the “Complete order” button, by which you accept these General Conditions of Sale and confirm having reviewed the Privacy Policy.
e) Before final confirmation, you can correct any errors in the entered data using the editing functions available on each screen.
The contract is concluded at the moment you receive the order confirmation by email, pursuant to Article 51, paragraph 7, of the Italian Consumer Code. If the payment fails, the order will not be processed.
10. Shipping and delivery
Dispatch times: orders are processed on average within 3–5 working days (excluding Saturdays, Sundays and Italian holidays). During busy periods (holidays, launch of new artworks) times may be slightly longer; in that case I will let you know.
Couriers: I use the Italian postal service (Poste Italiane) and other private couriers depending on the destination, weight and product type. All parcels are shipped with tracked service; the tracking number is sent by email.
Indicative delivery times (from dispatch): – Italy: 1–4 working days – Europe: 4–7 working days – United Kingdom and Switzerland: 5–10 working days – USA and rest of the world: 7–15 working days
Shipping methods by category: – Drawings, illustrations, watercolors, scarves, notebooks, colouring books, gadgets: shipped by tracked registered mail in rigid envelope, tube or suitable box. – Paintings / canvas works: shipped with dedicated rigid packaging (box with corner protectors and bubble wrap); courier and cost agreed individually with the customer after the order (see section 7).
Import duties and taxes: for non-EU shipments, any customs duties, import VAT or local taxes are entirely at the recipient’s charge.
Delivery responsibility: once tracking shows “delivered”, responsibility for the product passes to the customer.
11. Commissioned works (portraits on paper)
I create portraits on paper of people or animals on customer request, starting from photographs provided by the customer. Full details of the service are available on the dedicated page Looking for an original gift.
Workflow:
The customer sends at least three photographs of the subject; together we choose the most suitable one.
1. I create a first digital sketch and send it to the customer for approval.
2. Two free sketches are included in the price. Any additional sketch is subject to a 20% surcharge.
3. Once the customer approves the final sketch, I proceed with the single print and the hand-retouching of the definitive work.
4. I ship the artwork to the indicated address.
5. Payment terms and right of withdrawal:
A 30% deposit is due upon submission of the request.
The remaining 70% is due upon completion of the work, before shipment.
If after the two included free sketches the customer decides not to proceed with the definitive work, the 30% deposit is retained to cover the working time spent on the sketches.
Exclusion from the right of withdrawal:
Commissioned works are made-to-measure to the customer’s specifications, pursuant to Article 59, paragraph 1, letter c) of Italian Legislative Decree 206/2005 (Consumer Code). Therefore, once the customer has approved the final sketch and I proceed with the definitive work, the right of withdrawal is excluded by law.
12. Right of withdrawal — when it applies
In compliance with the Italian Consumer Code (Legislative Decree 206/2005) and EU Directive 2011/83/EU, if you purchase as a consumer you have the right to withdraw from the contract, without giving any reason, within 14 days from the day on which you (or a third party indicated by you) physically receive the product.
The right of withdrawal applies to all catalogue products:
Original artworks (illustrations, drawings, watercolors, paintings);
Scarves from catalogue;
Handmade notebooks;
Gadgets (canvas bags, calendars, cards, pins);
Colouring books / Do it yourself.
13. Exceptions to the right of withdrawal (when it does NOT apply)
The right of withdrawal is excluded by law in the following cases (Article 59 of Italian Legislative Decree 206/2005):
Commissioned works (portraits on paper): paintings, drawings or illustrations created on the specific request of the customer. The exclusion applies from the moment the customer has approved the final sketch and I proceed with the definitive work (see section 11).
14. How to exercise the right of withdrawal
To exercise this right you must inform me of your decision within 14 days from the date you received the product. You can do this:
by sending a clear communication by email to info@stefaniamorgante.com,
or by completing and sending the Standard withdrawal form that you find at the bottom of this page (section 24).
In your communication please indicate: the order number, your full name, the date of purchase, the date of receipt and the product you wish to return.
You will receive confirmation of receipt and the operational instructions for the return within 24–48 hours by email.
15. Effects of withdrawal and refund
If you exercise the right of withdrawal, I will refund all payments received from you, including the initial delivery costs — except for any additional costs arising from your possible choice of a delivery type other than the standard least expensive one offered by me.
Timing: the refund will be made within 14 days from the moment I receive the product back and verify its integrity.
Refund method: the refund will be made using the same payment method used for the original transaction (PayPal, Stripe, credit card), unless otherwise agreed with you. In any case, you will not bear any costs as a consequence of this refund.
16. Return of goods
Returned products must be shipped back to the following address:
Gufobardo di Stefania Morgante Via Primo Maggio 2 33017 Tarcento (UD), Italy
Return shipping costs: the direct costs of returning the goods are entirely at the customer’s expense.
Integrity of goods: you are responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature and characteristics of the product. Products must be returned intact, in their original packaging (if any), and packed with the utmost care to avoid damage during transport. If the item is returned damaged, the value of the damage will be deducted from the refund. For practical guidance on how to pack returned products properly, see section 23 at the bottom of this page.
17. Legal guarantee of conformity
All products are covered by the legal guarantee of conformity provided for by Articles 128–135 of the Italian Consumer Code. In case of manufacturing defects or non-conformity, please report this within two months of discovery by writing to info@stefaniamorgante.com.
18. Intellectual property
All content on the Website (texts, illustrations, drawings, paintings, photographs, graphics, trademarks, design) is protected by copyright and intellectual property laws.
When you purchase an original artwork, you purchase the physical support of the work (paper, canvas). You do not acquire the reproduction, publication or commercial exploitation rights of the image, which remain with the Artist. It is not permitted to
reproduce, copy, scan, photograph for commercial use, distribute or use commercially the artwork or its image without written authorisation from the Artist.
Private use of the artwork (display at home, photographs for personal use or on your own social media for non-commercial purposes, gift to third parties) is of course always permitted.
19. Limitation of liability
I am not responsible for delays or service disruptions attributable to the courier, force majeure events or improper use of products after delivery. In no case shall my liability exceed the total value of the order.
20. Privacy and data protection
The processing of personal data takes place in compliance with Regulation (EU) 2016/679 (GDPR) and current Italian legislation. For detailed information consult the Privacy Policy.
21. Applicable law and competent court
These Conditions are governed by Italian law.
For any dispute relating to the interpretation or execution of the contract, the competent court will be that of the consumer’s place of residence or domicile, if resident in Italy or the European Union, subject to the inalienable rights provided by the law of the consumer’s country.
For customers residing in non-EU countries, any dispute shall be exclusively referred to the Court of Udine (Italy), subject to the inalienable rights provided by the law of the consumer’s country.
22. Changes and updates
I may modify these Conditions at any time for legal, regulatory or organisational reasons. New versions will be published on the Website and will take effect from the date indicated in the heading. Please consult them periodically to stay updated.
23. Guidelines for return packaging
The products I sell are unique pieces, fragile and of value. To be entitled to a full refund, the goods must be returned intact. Please follow these guidelines:
Keep the original packaging: if possible, reuse the box, tubes, corner protectors and bubble wrap with which you received the order. They are specifically designed to protect the artwork during transport.
If the original packaging is damaged or no longer available, please follow these instructions carefully:
Drawings, illustrations and watercolors on paper: never fold the artwork. Use a rigid cardboard tube or place it between two layers of strong pressed cardboard.
Paintings on canvas (with or without frame): protect the corners with cardboard or polystyrene corner protectors. Wrap the entire artwork in at least two layers of bubble wrap and place it in a rigid cardboard box of the correct size, filling empty spaces with cushioning material.
Scarves: the fabric must not come into direct contact with adhesive tape or sharp elements. Close the scarf in a waterproof plastic bag before placing it in the box or shipping envelope, to protect it from moisture or liquids during transport.
Notebooks and gadgets: insert cushioning material (bubble wrap or packing paper) to prevent shocks during the journey.
24. Standard withdrawal form
(Complete and submit this form only if you wish to withdraw from the contract. Compliant with Annex I, Part B, of EU Directive 2011/83/EU.)
For any questions or clarifications, please write to info@stefaniamorgante.com. I will be happy to help.
